PARENTAL RIGHTS

Under the California Family Code, a parent cannot be discriminated against because of their sexual orientation.  Although this law is strict and absolute, it does not mean it is always followed.  Additionally, a parent that is not biologically related to the child has the same rights as the parent who is biologically related so long as the parents were married or registered domestic partners at the time of conception.  If you were not married at the time of conception, or even birth, the parent without biological relation to the child may still have rights.
