LEGAL v. PHYSICAL CUSTODY

Legal custody is a parent’s rights and responsibilities to make decisions relating to a child’s health, education and welfare.  There are two types of legal custody "sole” and "joint.”  Sole means that one parent has the exclusive right and responsibility to make decisions relating to the child.  Joint means that both parent share the responsibility to make decisions relating to the child.

On the other hand, physical custody relates to the amount of time the child is physically with each parents.  Essentially, it is the day-to-day schedule and timeshare.  Physical custody can range anywhere from 0% -100%.
