EMERGENCY ORDERS

Typically, when you make a request for order in family court you are waiting anywhere from thirty to ninety days for your case to be heard. The court understands that some issues cannot wait. When your matter cannot be heard on the regular court calendar a request for an emergency order can be made. The Court requires exceptional circumstances, and is very strict on the rules. Most commonly emergency orders are issued for custody or to protect property. Ex parte orders, as they are commonly referred to, generally only have a life of 21 to 25 days. The rules of notice and the threshold for an emergency are very specific. One tiny slip, and the request could be denied simply for technical purposes. At Blagof Law Firm, clients with emergencies come first. We don’t hesitate to work through the late hours of the night to ensure your case is promptly prepared and ready for immediate filing.
